Beginning July 8, 2026, the U.S. Consumer Product Safety Commission (CPSC) will require importers to file Certificate(s) of Compliance and/or data elements electronically, at the time of entry into the USA of regulated products.

The CPSC have provided a Regulated Product Database to determine which products require certification (e.g. toys, children’s products, batteries, certain furniture, paint/coatings, etc.).

Once you have determined which products are regulated by the CPSC, you’ll need to either:

  • Submit complete data elements with your shipping documents (or send ahead to your customs broker prior to arrival of goods) for each shipment,
  • Use the CPSC Product Registry to upload your Certificates – you would then need only reference that data on shipping documents (or in advance of entry to your customs broker), or
  • Provide a valid disclaimer, either ahead of time or on shipping documentation, indicating the product is not subject to CPSC certification requirements.

Note – entries flagged for this new requirement cannot be processed unless the appropriate certificate data or disclaimer is transmitted by the customs broker at the time of release.

The CPSC has provided a list of Harmonized Tariff Schedule (HTS) codes that are likely to include products subject to eFiling.  This list can help you identify products that may be flagged, but it does not cover every regulated product.  Importers must refer to CPSC requirements in order to determine if your product(s) are subject to the regulations, whether or not they are actually listed.

USA-manufactured goods do not require eFiling (though they still require product certification), and products imported into Foreign Trade Zones have an extended deadline of January 8, 2027.

CSPC has created a “regulatory robot” that they can input their products into and see if a Certificate is required.

CPSC requires that each certificate contains information for only one product. 

Certificate data may include:

  • A description of the finished product
  • The party certifying product compliance
  • The safety rules that apply to the product
  • The date and place where the product was manufactured
  • The date and place where the product was tested
  • Contact information for the person who maintains test records

Where a Certificate is on file with the CPSC, the following data elements will be required prior to customs clearance:

  • Statement of intended use
  • Product ID used in the registry
  • Product ID certificate version used in the registry
  • Certifier ID used in the registry

Where a Certificate is not on file with the CPSC, a full dataset is required prior to customs clearance:

  • Type of Certification and number:
    • Children’s Product Certificate (FCP), or
    • General Certificate of Conformity (FGC)
  • UPC number of the product
  • One (1) of the following item identity numbers:
    • MN – Model
    • SE – Serial number
    • RN – Registered number
    • ALT – Other type of unique identifier
  • Month and year of manufacture
  • Parties’ Roles including name, address and contact information for two (2) of the following parties:
    • CE – Certified Entity – Importer, MFG, Private labeler (address needed)
    • ITL – Independent 3rd party laboratory (lab ID number needed) *
    • LAB – Laboratory – (address needed) *
    • MF – Manufacturer – (address needed)
    • NOL – No lab testing required (testing exclusions)
    • PK – point of contact (contact info and address)

*Note: If an ITL or LAB are provided, the date of testing must also be provided*

  • Indication of the existence of a Certificate that meets the requirements of Section 14 and Section 17 of the CPSA, and 16 CFR part 1110 for the regulated finished product;
    • Yes – Certificate Exists, or
    • No Certificate Exists
  • If ITL, LAB, or NOL parties are declared, then the following information will also be required:
    • Citation Code
    • Lab test report ID, URL, or access key to the information
